PART 1: SMS TERMS OF SERVICE

1.1  Program Description

Midwest Movement Elkhorn ('we,' 'us,' or 'our') operates an SMS messaging program to communicate with current and prospective patients ('you') about chiropractic care, functional rehabilitation, sports massage, and related services. Messages may be sent from 10-digit long codes (10DLC) registered to Midwest Movement Elkhorn. Our messaging is conversational in nature — we use SMS as a two-way channel to answer your questions, coordinate scheduling, and support your care plan.

1.2  Message Types

By opting in, you may receive the following types of messages:

  • Appointment reminders, scheduling confirmations, and rescheduling requests

  • Responses to questions you send us via text message

  • Care plan follow-ups and progress check-ins from your provider

  • Post-visit instructions, home exercise program guidance, or resource links

  • Notifications of schedule changes, clinic closures, or availability updates

  • General administrative communications related to your care

1.3  Message Frequency

Message frequency varies depending on your appointment schedule and the nature of your communications with our clinic. Patients actively in care may receive a few messages per week. You control much of the message flow — we respond to your messages and reach out when relevant to your care.

1.4  Message & Data Rates

Message and data rates may apply based on your mobile carrier plan. Midwest Movement Elkhorn does not charge separately for SMS communications. Contact your mobile carrier if you have questions about messaging costs under your plan.

1.5  Opting Out

You may opt out of our SMS program at any time:

  • Reply STOP to any text message from Midwest Movement Elkhorn

  • Call us at (402) 256-6683 and ask to be removed from SMS communications

  • Email clinic@midwestmovementelkhorn.com with an opt-out request

After replying STOP, you will receive one final confirmation message. No further messages will be sent unless you choose to re-enroll. Opting out does not affect your ability to continue receiving care at our clinic.

Our SMS program is supported by all major U.S. wireless carriers including AT&T, Verizon, T-Mobile, U.S. Cellular, Boost Mobile, and others. Carrier availability may vary. Midwest Movement Elkhorn is not liable for undelivered messages due to carrier-side limitations.

1.8  Consent Is Not a Condition of Service

Providing your mobile phone number and consenting to SMS is entirely voluntary. You will not be denied chiropractic care, sports massage, rehabilitative exercise, DOT physicals, or any other service offered at Midwest Movement Elkhorn based on your SMS consent status.

1.9  Changes to These Terms

We reserve the right to modify these SMS Terms of Service at any time. Updated terms will be posted at midwestmovementelkhorn.com/sms-terms. Continued engagement with our SMS program after notice of changes constitutes acceptance of the updated terms.

PART 2: SMS PRIVACY POLICY

This SMS Privacy Policy explains how Midwest Movement Elkhorn collects, uses, and protects personal information gathered through our text messaging program. It supplements our general website privacy policy and applies specifically to SMS communications.

2.1  Information We Collect

When you opt into SMS communications, we collect:

  • Your mobile phone number

  • Your name (as provided at intake or on our web contact form)

  • The date, time, and method of your opt-in

  • Message content for quality assurance and compliance purposes

  • Opt-out requests and dates

2.2  How We Use Your Information

Your mobile number and associated information are used only to:

  • Deliver SMS messages relevant to your appointments and care

  • Respond to questions and requests you initiate via text

  • Maintain records of consent and communication preferences

  • Comply with applicable laws and mobile carrier requirements

2.3  No Sharing for Marketing Purposes

Midwest Movement Elkhorn does not sell, rent, lease, or share your mobile phone number or SMS opt-in data with any third party for marketing or promotional purposes.

We will not use your number to send you marketing messages from third-party businesses. Any third-party vendors who assist in delivering our SMS messages (such as our messaging platform provider) are contractually restricted to using your information only as directed by us and may not use it for their own marketing purposes.

2.4  Third-Party Service Providers

We may share your contact information with third-party technology vendors that assist in operating our SMS program. These vendors are bound by data processing agreements and may not use your information for purposes outside the scope of services they provide to Midwest Movement Elkhorn.

2.5  HIPAA Notice

Midwest Movement Elkhorn is a healthcare provider. To the extent that SMS communications involve health-related information, we handle that information in a manner consistent with our obligations under HIPAA. However, standard SMS text messaging is not an encrypted channel. We do not recommend transmitting detailed clinical health information via text. 2.6  Data Retention

Opt-in consent records and SMS communication logs are retained for a minimum of four (4) years, or longer as required by applicable law or healthcare regulations. Opt-out records are retained permanently to prevent inadvertent re-enrollment.

2.7  Security

Midwest Movement Elkhorn uses reasonable administrative, technical, and physical safeguards to protect the information we collect. No transmission method is entirely secure, and we encourage you not to send sensitive personal health information via text message.

2.8  Your Rights

You have the right to:

  • Opt out of SMS at any time by replying STOP

  • Request confirmation of your opt-in or opt-out status

  • Request deletion of your mobile number from our SMS program records (subject to legal retention requirements)

  • Ask questions about how your information is used
